City wants to investigate medical pot

The Monterey Herald

Interest in opening a medical marijuana clinic in Marina triggered a request by city administrators for an urgency measure to give them time to investigate the issue.

The Marina City Council today will consider approving a 45-day moratorium on permits for medicinal marijuana dispensers. City planners recently received inquiries about opening such an outlet, a report to the council says.

The proposed moratorium would allow city officials time to further investigate the pros and cons, the report says. The city has no current laws regarding medical uses of marijuana.

The council meets at 6:30 p.m. today at the Civic Center at 211 Hillcrest Ave.

MARINA, Calif. -- The City Council voted Tuesday to ban medical marijuana dispensaries from the city.

Staff members are now drawing up plans to change the zoning ordinance, making it illegal to open such businesses.

A Bay Area man inquired about opening a pot club earlier this year. Since that time, city officials have been working to prevent that from happening.

Those in favor said there is a need for such a shop, claiming that it would be a good service for those who have a medical need.

There are currently no medical marijuana dispensaries on the Monterey Peninsula. The closest pot dispensary is in Santa Cruz.

The city of Marina is poised to become the first jurisdiction in Monterey County to rule out medical marijuana clinics.

The City Council today will consider zoning amendments that would put a permanent ban on medical marijuana dispensaries in the city codebook.

The Planning Commission is recommending approval of the ban on marijuana clinics.

On Monday, Councilman Ken Gray said Marina is too small a city to get caught up in the conflict between state and federal laws on the medicinal use of marijuana.

"We just don't think the little city of Marina should take on those national issues. Larger cities with larger financial resources can address those issues," Gray said. "Marina is just not in a good position to take on a challenge like that."

Though California law is generally supportive of the medicinal use of marijuana, federal drug agents have raided clinics in keeping with federal anti-marijuana laws.

Gray said he hasn't heard any residents of Marina speaking in favor of allowing marijuana clinics in the city.

Both Marina and Seaside now have temporary moratoriums in effect against such clinics -- actions prompted by inquiries last year about the possibility of locating them there.

City staff members say medical marijuana clinics wouldn't promote Marina's general plan policies. The clinics wouldn't generate sale taxes and could prevent tax-generating businesses from finding space in the city.

If the council approves the recommendation, final approval of zoning changes would come Feb. 20, and the ban would take effect 30 days after that.

MARINA, Calif. -- The Marina City Council voted Tuesday to permanently ban medicinal marijuana clubs.

The council voted last year to put a temporary ban in place a Bay Area man inquired about opening a pot dispensary in Marina.

Medical marijuana is allowed under state law, but there are no dispensaries on the Monterey peninsula. The closest pot club is Santa Cruz.

In an unrelated item, the council voted unanimously against merging the city fire department with that of Seaside.

Instead, the council opted to begin research on building a new fire station at the corner of Eighth Street and Imjin Road.

Marina City Council members want no part of their community becoming the first site in Monterey County for medical marijuana clinics.

The council rejected appeals Tuesday from medical marijuana advocates and voted 5-0 to ban clinics under the city's zoning code.

Councilman Mike Morrison was peeved that some of the handful of proponents were from other cities on the Monterey Peninsula. He suggested they espouse their cause closer to home.

"Marina is not the place to forward a social agenda," Morrison said.

Councilman Gary Wilmot noted that while California law allows medicinal marijuana use, federal laws ban the drug.

"We're not here to enforce some of the laws," he said.

"We are a nation of laws," Morrison said. "We the people have to follow them."

Some suggested lifting the ban if federal law changes and would allow medical marijuana outlets. Wilmot said that if that happens, chain drug stores will be selling marijuana medicine and small outlets won't be needed.

City staff members said allowing marijuana clinics in Marina could increase law enforcement costs and cause unexpected turnover in commercial rental property if a clinic is raided by federal drug agents.

Several members of a local group called the Foundation to End Drug Unfairness Policies, or FED UP, urged the council to allow clinics as a compassionate move for cancer patients and others who benefit from medical marijuana.

They said the city shouldn't put a blanket ban on its books without considering the merits of a specific application.

Lawrence Samuels, group chairman, said clinics would provide an outlet for medical marijuana that professional caregivers would distribute. The other option, he said, is to easily buy illegal marijuana on the street.

David Henderson, an economics professor at the Naval Postgraduate School in Monterey, said, "People have the right to risk dealing with the federal government.... Don't make people's decisions for them."

Testimony against medical marijuana outlets came from several Marina residents. Some comments verged on comedy.

One woman said she wouldn't want to be shopping in the local supermarket and have people who just left a marijuana clinic running into her cart while under the drug's influence.

Jeff Post, a Marina resident, said he would be all for medical marijuana "as soon as it's sold at Walgreens."
